Well...Lelouch used his Geass to kill Charles and Marianne with his "Be Gone" command. And we know that a high-leveled Geass is needed to kill its predecessor. Maybe Lelouch doesn't need contact with Charles to absorb the code, maybe you only need to kill the person with the code using the Geass...
