He can't, CD at that particular time point is not even in the item slot that's how it got overlooked in the first place.
And yes CD is dead when crow stuck that sword into his own chest. So even if Cerberus II wanted to it cannot obtain CD because it's no longer CD and the restored items aren't on fattso anymore.
