Where you live isn't as important as where you are- If she's in Japan, she's not an adult... And going by the fact that she is still Japanese, and that this is a Japanese story, I reckon the intention is to follow the Japanese standards when it comes to her.
Also, Touma got drunk once and he isn't an adult.
