It's not shooting Alicia who made Faldio someone who need to be executed. He took the princess as hostage and menacing to kill her with a gun.

This crime can't be pardoned, even if as a person, Cordelia know Faldio as right to do that, as a princess she must to punish him.

and an execution ordoned by military court is allowed.

The place of faldio is in jail until the military court take a decision about him.
