If Shirou doesn't kill Saber, then Sakura calls her back and uses her to subdue Rin when Rin pisses her off with her "I don't give a crap" speech. Thus, if you allow for Saber Alter to be recalled by Sakura in that way, you get bad end 40. Also, Saber heals almost instantly, thanks to Sakura's mana supply, and she's also Sakura's servant, so if Sakura were to be freed she would likely obey orders and just give up.

Well, I was going more on the assumption that she takes a bigger beating, and might actually have started to be killed, but not entirely. Otherwise, some heavy rewrites would have to happen for that area to carry it out.
