The first picture you're showing us doesn't support the idea that Tobi is not Madara. In fact it supports the exact opposite, by Kakashi asuming that Tobi is Madara.
As for the second picture, yeah, I think that is the strongest hint towards Tobi not being who he claims to be, at the moment.
