xBTAx is right. Torrenting (and any other type of downloading) a game unpaid is legal only when the rights holder allows free distribution.
Even if we don't care about laws, I reckon the decent thing to do is to compensate someone for the hours, weeks, months, maybe years, they put into a game, if we play it.
If I'm not mistaken: If no American company has a license for the game, it just means that no American company is allowed to edit and sell it -- it doesn't mean that the game is unprotected in America (correct me if I'm wrong)
