But anyone that isn't an ESPer can use magic right? Since magic was a way for ordinary people to gain abilities on the level of people with abilities?

ESPers actually can use magic but their AIM fields would violently reject it. This includes Level 0s as well, even though they don't have powers, as demonstrated by Tsuchimikado. Anyone who isn't an ESPer can use magic normally like Komoe-sensei at the beginning of Index. However, take note of this conversation:
