A mistaken stun would have far smaller consequences than what we've seen. Hell, that's the reasoning behind "stun the victims first, send them to therapy later".
Besides, it's stupid to use merely a mind scan at the expense of the actual, present situation. No, it's not a situation that's going to occur very often. But it should still be accounted for.
