It was licenced in production. Bandai said they had the licence way before it even aired on tv. Then we had the whole farce of Cartoon Network claiming they had the broadcast licence (they didnt) and that they planned to air it very close to the japanese dates.
As for the second series, bandai came out and said it had been extended, hence the delay with the dvds.... i think you can safely add that as licenced.
