I also think that kakashi might still be anbu, i think that sandaime ordered him out of anbu to lead team sasuke... i don't know if it was stated in the manga also but it was pointed out that the sandaime was trying to keep the the same team chemestry that had been used in previous generations. and kakashi was best leader...

but he also had other students in the past before...the ones that he failed.
so...hmmm.
maybe because he was just a respected ANBU leader/squad captain that he can pull some strings and have ANBU follow his "orders".
