there are a few evidence that back up this idea:

1- Shanks and buggy and most of his crew watched his execution, if he was cough they could at least try to save him which they didn't even try to do.
2- shanks taking over his crew after Roger's death at age 15 ... no one would accept that if it wasn't Roger's will.

1- Shanks and Buggy were the only ones we are certain were there, nothing is mentioned about the rest of the crew... the execution was probably guarded, and it could be that Roger gave the order that no one were to risk going after him if he were captured... captain's orders are absolute.
2- For one thing, just because roger was captured and excuted doesn't mean he couldn't have passed down is will to his crew, I.e. naming shanks his successor sometime before his capture... and second it was never stated that Shank's crew was roger's old crew, only that shanks went on to become a captain after the event; he could have bascially started from scratch... It actually is questionable wheather or not the rest of roger's crew are even alive, buggy and shanks could be the only ones left from what we were told... i mean, Since buggy and shanks were considered cabinboys (i think), they may have been able to escape from the marines sights since they would be concerned with the strongest pirates first...

Though one thing that does come to mind in support of the surrender theory, is roger making a deal to keep some of his crew alive... though it's questionable as to whether or not the marines would make such a deal...

like i said, Its a fair possibility and it's not farfetched... but i'm still sticking with him being captured
