fix my group name please

my group released hand maid mai ova 01

The name of my group is anime-works and we are on mirc-x

When it was first posted the name was correct but by some strange reason it now only says "works"

Please fix this

imagine what you would read if the anime from animejunkies was gone

I changed the name to Works since Anime Works is already a trademark.

Anime Works is part of the Media Blasters group.

we have always been anime-works, for over 4 years now

so unless the adv animeworks makes a irc chan please give our name back

I have no intention of making you change your IRC name or channel. I have no intention of forcing you to change your group name.

Currently on AnimeSuki you are listed as Works.

Trademarks are case-insensitive.

Just change your name, AnimeSuki will not list it as it is because it might get them sued.

add the # sign

if you add that you cant be sued because the name is completely different

so please make it #anime-works

A quick question. Trademarks may be case-insensitive, but I'm pretty sure that they aren't Hypen-insensitive. Aren't they?

"Anime-Works" should be different from "Anime Works" shouldn't it?

I think you'll find when arguing distinctive-ness the courts would be with the company on this one. It would be like someone trying to use "micro-soft". However, the most they can do under US law, as I understand it, is an injunction preventing its use. Anime-works are not aiming to deceive the public (I doubt their logo is a copy or coloured replica of the trademark, for example), making money from the mark, or willfully defaming the mark etc. Now, while in this instance they may only get an injunction, it could be enough to push the company into to following other more serious lines of inquiry, regarding copyright infringement for example. It isn't worth the trouble.

this seems kind of insane, you won't list there name because of copyright infringement which i would be understandable of EXCEPT for the fact that right at the top of your forums is a licensed character who also is protected under copyright laws, and I HIGHLY doubt you paid the licensing fees to use that character. I mean i don't care either way it just seems kind of hypocritical to me, you using Sugar on the top of your forums and i see no mention of the intellectual property rights of Sugar mentioned at all.

Please see warnold's post in this thread for the relevant difference between copyright and trademark infringement. I'm also going to close this and let any further discussion move to that thread, so it stays in one place.
