Why would you think that? Just because they committed a crime doesn't mean they lost basic civil rights. While a lot of inmates try to make a legal nuisance of themselves while behind bars, to get back at the legal system, a lawsuit can be used to address legitimate grievances they may have with how they're being treated in prison. Inmates need some sort of legal recourse to address abuse and mistreatment by the prison staff. Of course the nuisance suits make that even harder as legitimate suits are then lumped together and dismissed.

Or more to the point, that you are never imprisoned falsely. I am against the death penalty because I don't trust human judgment to be right in saying someone deserves to die. As in, I personally might want some criminals killed (child rapists), but I don't think I'm capable of making a prudent choice in such a situation, nor is anyone.

And why shouldn't he be allowed to? Just that, he should file his case only AFTER getting out. Otherwise, it'll negatively affect his case. I studied law for some time, I should know.
