how does licensing work?
when fuji creative corporation has viz communications license their anime in america, what is it that viz does that fuji decides that it cannot or would rather not do themselves? also, there are 191 other countries on earth. who is responsible for licensing anime outside the us. can anime be distributed and broadcasted in a country without that anime being licensed in that country. how much would a network have to pay in licensing fees to broadcast episodes of anime.

What you have to realise is that licensing anime is no different than well, I dunno, buying anything really. Concerning liscensing in the US and such, first of all, a company has to make some kind of payment, nad they also have to go over various contracts with lawyers, and other legal-men and women, have to decide how the show will be released. Merchandise? Straight to DVD or TV broadcast? Will it be allowed to have Japanese? How many volumes? Do we have to buy this show in order to get this show? Name changes?
Fine line is that there is no real, definant process to it. Your license can extend across the world, it can only extend to certian parts of the world, it can do all kinds of things. |

Since there are no answers to found I will provide some.
When Viz licenses an anime series, they have the right to redistribute the series. So to effectively due this they will translate the Japanese dialogue and create scripts for the dub actors and subtitles. There are only two other options for people outside of North America, either US companies distribute in that region or another company picks up the rights for that region. An anime series cannot be broadcast without someone picking up the rights to it. The other questions we cannot answer since companies do not release that sort of information to the general public or share it with other people inside of the industry. |

When they license a series, they may also pick up the TV rights or anyother rights (ost's, toys, etc). Typically, the company approaches the japanese company and goes "we want this", the japanese go "we want this" and they go to some deal. Basically involving either the exchange of money or production costs or cofunding or picking up other series with a major series or whatever the japanese company wants and can put in that contract to make the most $$$. |

However, we as public people will never see the details of any such contracts whatsoever. So although we might know the general process of how it's done, we will never know the specific details of what goes on. (Unless you went to work for such a company, but even then you would be forced to sign non-disclosure agreements that would prevent you from leaking such information... )

In simple term here how licencing work. First the author at the creation of a work have the copyright for the original idea. The author have a contract with a japanese production compagny who produce it and has the copyright for their product. The japanese compagny has the worldwide copyright. They could if hey wanted distribute everywhere in the world. But they concentrate on their market because to actualy distribute everywhere they have to enter and respect all systems of different country and local laws and have a worldwide distribution infrastucture It much easier to take the money for a licence and let the regional compangy take care of the distribution. A licence is basicly a partial transfer of the copyright to another party so the other partie can take care of the distribution.
ie. Japanese origin the worldwide distribution right. But they don't want to actualy market for the US so they sell the US distribution right to an US distributer. That why there is not realy a difference between licenced and unlicenced because there is no new right created is only a contractual transfer of right. The only difference is who has the right distribute and sue offenders if need The japanese compagny or the American compagny. ps. the copyright is more than just distribution it may also include all derive product(Toy, costume and what not) |
