First of all it seems to be a slightly different picture (judging by the position of her hand), but even if he used the exact same source you didn't copyright it.

Hurry up everyone. Contest is almost over. And I'm going to have to disqualify both fenrihr and Mb81's banners, if they don't fix them. It will be a shame because they are both nice.

Hey, don't pick on my banner.

Seems like we are in fact using the same picture source. I didn't notice that before you mentioned it. HOWEVER, wether or not we are using the same pic source should not matter at all. It's not the pic of the character that makes a winning banner.
Picking on my banner tells me my banner is simply the best.
