Even if they have not been released, have the las two volumes been already licenced in the US, and therefore, it is ilegal for anyone to translate them into english?
But if they are licenced, it means that a english release should come out quickly, and for those who think it is worthy (which would mean, everybody), can buy it online? |

there are some grey areas which are complicated to explain. and I'm not qualified enough in law to do so. but if you're hoping for B-T to take it up, we've discussed it before and it's highly unlikely we'll waste time to put up something which will be taken down in time because it Will get licensed eventually.

It would be quite complicated legally. The company authorized to do the English translation is probably based in the US, fan translators are based everywhere, and the laws are a bit different everywhere too (e.g. in the US they have a 'fair use' defense against copyright infringment, in Hong Kong we don't, at least not in the same way as the US).

fair use is not omnipotent, and its extent is often misunderstood. furthermore, it strictly does NOT apply to licensed series, since that will blatantly violate the fourth factor of analysis, "the effect of the use upon the potential market for or value of the copyrighted work". and volume 10 will definitely get licensed, so it's a waste of effort to work on it.

Mantan Web is reporting that the reservation total for the First Press Limited Edition of The Surprise of Haruhi Suzumiya (Former) (Latter) has reached 513,000. It's a new record for reservations in Japan for a first press of a light novel.
For reference, the total sold for New Testament: A Certain Magical Index had reached just under 180,000 for 4 weeks when it ranked 3 weeks ago. Also, the entire series has now had over 8 million copies in Japan printed of the light novels and 16.5 million copies worldwide combining novels and the manga.

Kadokawa's specialty site was updated today with the information about the first press. They also uploaded an image of the cover designs. While we can't read anything from the summaries, it does confirm one thing: The Surprise of Haruhi Suzumiya (Latter) is indeed Volume 11 and not 10b.
