Question Is posting Game FMV illegal?

I was just wondering as with Anime Torrents going on, would game movies Torrents be illegal?

Such as a Final Fantasy's intro or ending?

What about music video edit?

I'm talking about posting them, not selling them.

Oh yeah, anyone knows a place where I could download those?

As long as you do not have the copyright holder's permission, it is illegal to distribute parts of the game. Of course one can argue that it doesn't hurt the company's income in any way, but as the license says: reproducing/distributing the product partially or in its entirety is forbidden without the copyright holders consent.

Music video edit is technically illegal too, I think; as far as I know it is not covered by the "fair use" laws, and you need permission to use the material. I'm not so sure they care too much though.

I'm not an expert in law, so don't take my word alone for it, but I do believe it works this way.

I don't think torrenting game intro is illegal, or else Gamespot has been sued a long time ago. But the ending or any movie rip from the game itself it could be illegal. I'm not sure. ^^

acutally I once did a research on Copyrights and Intellectual Properties. There is a chapter in fair use, here's the excerpt:

Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

1. the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;

2. the nature of the copyrighted work;

3. amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

4. the effect of the use upon the potential market for or value of the copyrighted work.

The distinction between “fair use” and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the copyrighted material does not substitute for obtaining permission.
Have anyone heard of CHV.Net that existed long ago and which is no more, because they ran out of money, not sued. Does anything like that exist now? A place where I could download FF Movies.
