To be specific, many cable companies do either block ports or filter BitTorrent traffic. This greatly reduces BitTorrent performance. Even if a company does this, it doesn't mean that they do it all over their service area (that is, where they're geographically serving). Generally, if they are capping it, it's just a matter of time before all of their service areas are capped, but that explains why some people will feel the capping while others will not, even if they're both under the same service.

As you also mentioned, companies will also cap bandwidth if they feel that you're using an excessive amount. This varies with each company regarding what their limits are. What seems to be the standard practice is that, should you use an excessive amount of bandwidth, your connection will be severely capped. The only way to remove the cap is to call the company and have them to do. To avoid being capped again, you'll need to be a bit more careful about your usage.

Lastly, there's the factor that The Small One mentioned. Cable is essentially one giant line that a lot of people are sharing. If a lot of people are heavily drawing on the bandwidth, there's less overall to go around, and you may experience decreased speeds. You could check this by trying to use your connection during peak hours (late afternoon to evening) and compare it to use during off-peak hours (the twilight hours to morning). This used to be more of an issue when cable was relatively new and the infrastructure wasn't as built-up as it is today. It's possible that it'd still be an issue in certain areas, of course.
