Some people are missing a memory or two - there were digital fansubs of real media + SAMI subs as early as 1999. Love Hina also had a couple episodes done that way.

DVDs (at least in NA) encode the captioning into the MPEG-2 stream. Only the player enabled subtitles are stored as a bitmap overlay stream.

Actually it goes both ways. For example, my DVDs of Slings & Arrows don't have DVD subs but they DO have closed captions. Japanese discs are infamous for not having subtitles, but some do have CC's.
