No it was said that they did marry. Kinzo also said Maria was born from a nobody so I don't think he consented the marriage.
The reason I want him to be Maria's father is because I want to know what is going on with him. We don't know anything about him at all. And him being Maria's father might make it a Kakera where Battler never arrives and Maria's father never left so he's there too.
Kind of like how in Higurashi Minagaroshi hen they're in a Kakera where Akasaka's wife never dies and he goes to the festival
