Ah, that was where I started mixing canon with some things I made up to help further the story. There, I
did mean for it to be Fate speaking, as I had Fate both slightly clone Nanoha and also do the spell to make her a familiar.
I didn't mean to imply that Fate was Precia's familiar (although Precia
did use her knowledge of familiars extensively to actually create Fate, who was Project F's first success). I meant that Precia
cloned Fate, and Fate used some of that same cloning magic to replace the parts of Nanoha's body that was dead.
(By the way, I did visit that link before writing the story ^^, which is why I had to force some convoluted stuff in to fit with the makings of a familiar)
My original intention was for Fate to have cloned Nanoha an entirely new body, then put her soul in to make the familiar. However, as you pointed out, cloning takes a long time, so I had to make some adjustments. My compromise was that when Nanoha died, the brain death would have made her body, well, dead
. So what Fate did was hold onto Nanoha's soul with the familiar spells, then use the cloning spells Precia had used/learned in Project F to
clone Nanoha's brain (and other dead tissue, like heart tissue or something), in order to make Nanoha's body alive again. Fate
then used the rest of the familiar spells to bind Nanoha's soul to her alive, half-cloned body and make Nanoha her familiar.
So since Fate had to use her magic to partially clone Nanoha's body, I hoped that would count for the "new body made of the mage's mana" part of creating a familiar
.
And we do know what happens when no contract is made: Arf had no contract with Fate, so I'm going along those same lines with Nanoha (as I can't see Fate forcing a contract with Nanoha, although like you said, if the TSAB decides to intervene it could cause them problems).
And about the legality, the reason why Fate was charged (charged, but not necessarily convicted yet) with potentially making an Artificial Mage was due to the partial cloning she did of Nanoha to replace her dead body parts. Even though that doesn't have anything directly relating to the fact that Nanoha is now a familiar, is the main thing the TSAB is using to try and convict Fate. (Since making familiars out of animals is legal, and as I said before, humans are technically animals, biologically. Unless it's clearly stipulated in TSAB laws, it could provide Fate's defenders with a loophole)
