The gun activates it's Lethal Mode based on target's threat. If target at the moment is threating (known or unknown by him/herself) police officer's life, dominator just switches from Non-Lethal to Lethal Mode.
And when it choses to eliminate the victim, she is in panic, she is in fear of Enforcer, she has a lighter in her hand, and she lies in a puddle of gasoline. Shinya just walks towards her and stops in the same puddle of gasoline. Dominator sums it up in life-threating situation and switches in Lethal Mode.
