It isn't free because it's patent-encumbered, and distributing H.264 video is only royalty-free online, and up to a certain date; using H.264 for broadcasting video is still subject to H.264 patent licensing, as far as the licensors are concerned.
Also, I thought we were on the subject for using H.264 as 'standard' format for HTML5 <video>, not fansubs. Everybody knows that fansubbing violates the Berne convention in pretty much every case.
