But the problem will come if he shoots down the Master of someone he is having a battle with and when's having fun (like Uryuu and Caster? He wouldn't have objections there). Although, he'll be probably more interested in Kiritsugu himself than the Servants, considering he's pretty much like Saber as you said. The thing is that Tokiomi wanted him dead, Kiritsugu wouldn't. Death's a huge trigger for Gilgamesh.
Kiritsugu wouldn't outright ignore him, but he certainly wouldn't treat him like a king (on the surface) the way Tokiomi did. The contract working and lasting or not would depend on how tactful Kiritsugu would be when dealing with him. Gilgamesh does become more tolerant towards impudence when it comes from individuals he finds interesting, so they could manage to function together I suppose.

And another big difference would be that Kiritsugu, being the proactive hunter he is, should actually make good use of Gil's overpoweredness, instead of holding him back and making him retreat the way Tokiomi did. But there's always that problem of him sniping the Masters of fun opponents, of course. If Kiritsugu were to shoot down Waver while Gil was fighting Rider, things could get pretty ugly.
