1. At that point, nobody really realized that Kotomine was part of the previous Holy Grail War. While Shirou disliked him at the first glance, all he had was suspicions to go on, and nothing more.

2. Before I can answer your question, you need to understand a few things:

The Holy Grail War (which will henceforth be called the Heaven's Feel, for reasons that I'll explain soon) is nothing more than a ploy. All the participants, save for a few, in this war are being tricked by the Makiri(Matou), Tohsaka, and Einzbern. The "Holy Grail", as it is called, is not primarily a bearer of wishes, but something else entirely.

The reason why the Heaven's Feel is completely different from all the other Holy Grails in the world (which, not including the original, is more than 400) is because of the Servant system. The Servants usually are completely impossible to summon; in fact, their very existence can be considered a "miracle". It is impossible to bring back souls that have already died through sorcery or otherwise, thus explaining the name Heaven's Feel. Such miracles of sorcery are called "Magic" (there are five left over in the world), and in this case, the Heaven's Feel applies the Third Magic.

The sorcerers that participate in the Heaven's Feel originally believe that they will granted with an infinite source of mana, which they believe will allow them to satisfy any of their wishes. However, the true purpose of the Heaven's Feel is to bring back that Third Magic. The original families wish to finally be able to freely use the Einzbern's lost miracle. The outsiders who realized the truth decided to go along with it, since it's still beneficial to them.

In the first two Heaven's Feels, the Einzberns lost horribly early. Because of their previous failures, they decided to summon something completely new and different to raise their chances in the third Heaven's Feel: a god by the name of Angra Maniyu, in the new eighth class, the Avenger. Unfortunately, the Holy Grail was unable to process something like a god, and instead brought forth a normal person that was sacrificed in place of its place. As expected, Avenger lost badly in face of the warriors in the Heaven's Feel, but when it died, it was stuck inside the Holy Grail. As it continued to stay in the Holy Grail, its evil started to corrupt the pure artifact, turning it into the Holy Grail we know today.
