I'm not sure how you jumped from "game designer who did this" = "safe public game under legal standards", because I'm wondering how it could have been considered safe to the public in the first place if it was able to cause such damage in the first place. Whoever decided that it was okay to sell this to the public is gonna get fried for being irresponsible.

Like you I wondered about that, but then I started thinking about it.

Remember that it was in Beta for what sounded like a few months.. it was entirely possible that Kayaba didn't add in the code that did this until it went Gold Master.

NervGear was a revolutionary new game system created almost entirely by Kayaba who was considered a genius like Stephen Hawking for the computer field. It apparently used some sort of microwave to intercept signals in the brain to create an almost 'real world' quality VR.

This part is a guess, but I think nobody considered that under the companies techno branding of the technology(Like 'Real Beats Audio', 'Keplar', etc) that it still boiled down to old fashioned microwaves technology.
