Maybe, but in Kaouko's case this will be suitably substituted by whole incest issue. In The Tale of Genji Fujitsubo is forced to go undercover and hide identity of real fatherhoods of her child due her being Emperor's lover. If things happen same here, is fairly obvious that Kaoruko will must do same for more apparent reason.

Not really. Kaoruko is fairly eccentric and Minamoto is legal. She would have to quit school if it happens before graduation, but that's pretty much only consequence (putting aside possibility of being stabbed by jealous targets of conquest of course).

At least I think she is not one to obediently conform to rules of society to not insult anyone's sense of values.

There simply isn't any law in Japan that would forbid it as long as both parties are adult (or at least in age if consent). They just can't generally get married, it's considered taboo and is frowned upon by society.
