Statistical rise of lolicon popularity outside Japan
One way to compare the popularity of lolicon inside and outside Japan is to look at Google search trends for the Japanese spelling (ロリコン) and the English/Spanish spelling (lolicon).

This interest isn't just centered in America...it's led by Latin American countries, such as Mexico, Chile, and Peru. Sankaku Complex also looked at something similar, comparing Google search trends for "loli" and "ロリ" since 2001. Both rose, but they've become almost equal (13,600,000 to 13,300,000). But I think this data challenges people's conceptions that "Lolicon is a uniquely Japanese phenomenon," or that "Only the Japanese are lolicon." In coming years it's likely that the amount of lolicon fans outside Japan will equal, or even greatly surpass, those native to Japan. It makes one wonder if, without the current restrictive laws and Puritanical publics in Western countries, Western production of lolicon manga and products would be able to rival that of Japan. |

Well...Sankaku's comparison between 2001 and 2008 is not very significant. Between those 7 years is when all the authors jumped on the Internet to show off their work (in every genre), so naturally traffic on that is going to increase.
I see a possible cycle here between "on-backlash" right after the high-profile otaku incidents and "off-backlash" right now. |

Well, that exact thing is being tested right now in the Handley case. "The case started back in 2006 when Mr. Handley got some manga shipped from Japan and the Postal Inspector took a peek. Shortly afterwards, cops showed up at Handley’s home and searched his extensive collection of 1,200 manga, along with his computers. Handley’s lawyers scored a major victory earlier this year when a judge found portions of the PROTECT Act unconstitutional. The legalese in question makes it a crime to knowingly produce, distribute, receive, or possess with intent to distribute, “a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting,” that “is, or appears to be” a minor engaged in sexual conduct. So yes, it would seem we’re talking about loli/shota here. But Handley isn’t out of hot water yet. He still faces charges for possessing “legally obscene” material. The material cannot be deemed obscene unless it meets all three of the criteria of the Miller test for obscenity: “(a) whether the average person, applying contemporary community standards would find that the work, taken as a whole, appeals to the prurient interest; (b) whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law; and (c) whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.” The jury must answer all three questions in the affirmative in order to convict." Who knows if it'll actually end up going to the Supreme Court, though. Quote:

I don't like lolicon and shotacon. It seriously twists the minds of some and it turns from a 'fetish' to an attraction to kids in real life. Messed up shit. >_>

Well again, this is a complicated matter. Earl Warren, possibly the most liberal Supreme Justice, chief justice from 1953-1969, he led to what's called the civil rights "Revolution"...he interpreted the Miller test in a very narrow way...that it had to COMPLETELY lack value, in a way that meant basically everything passed the Miller Test, even pornographic films like Deep Throat and such. This liberal interpretation got rolled back in the Nixon and Reagan years. Judicial law is a funny and fickle thing...
