Depends. In many countries OTHER than the US of A (and probably China), such lawsuits are a waste of money - for example, if you sue just because someone poured coffee on your best skirt and scalded your lap, at most the waiter gets the dry cleaning bill and/or the cost of a tube of burn cream. If the waiter is apologetic, the charges may be mitigaed and you just wasted money on a lawyer.
