If it wasn't, then all we're doing is speculating. I'm aware of that, so I'm not claiming that what I said is what has actually happened...but are you saying that you know that they definitely patented the activation sequence itself? Based on what we have been shown?
As for the hardware, that's a separate piece of intellectual property, and FLT would have applied for a separate patent for that (if the system in Mahouka is the same as in our world, that is).
