That is true, but the inescapable fact is that all SE had to do was get their permission as they did from Capcom and the others and there would have been no problem. And they even had the gall to print a copyright permissions page implying they had.

Square Enix has been a bad decision machine and projected unyielding arrogance in many cases that really didn't call for it for the better part of the century so far though so it comes as little surprise. I still can't get over their unwillingness to release Bravely Default outside of Japan leading to Nintendo having to step in and release it themselves only for it to prove to be a greatest hit best seller by the end of last month even surpassing Square Enix's beloved Lightning Returns which they could not wait to get out the door and focused a ton of advertising on. Over 1 million copies sold for that title with 600,000 being in the west and 400,000 meaning if Square Enix had gotten it's way it would have never reached it's full potential. It just boggles the mind how they seem to be actively seeking failure at every turn when success is staring them right in the face begging them to grab it and how they pissed away one of the greatest reputations in gaming and a ton of good will from the 90's transitioning into the 2000's. From a strictly business/legal oriented standpoint I just don't get this company.

Anyway this sucks cause this is a fun little nostalgia trip of a title that I was kind of looking forward to seeing animated. It's like finally a 4Koma I can relate to that doesn't primarily center around uber niche and pervy humor or cute girls being cute as you pointed out, but alas....

I consider it a lot more than a fun little nostalgia trip - it's a hilarious and quite powerful story with a lot of great character development. It's also not a 4-koma.

That's the main issue, really. It is one thing to forget to give credit and to get permission, it is quite another to pretend you have the permission. That's something lawyers would notice.

sigh... I'm sad for the news. And I just read volume 1 and I love it... I hope the story will continue somehow. is there a chance it will continue? and what about the anime?

The good news is, Squeenix hasn't entirely given up on the series. They've filed a counterclaim asking for a declaratory judgement in their favor. There's a possibility this might get animated before the Tokyo Olympics.

Bad news, they are going ahead in prosecuting 16 people including the author. Everyone denied knowing they didn't have the rights. It seems they don't have anyone specifically responsible for organising copyrights. This is not unusual as Japan doesn't actually have that many lawyers compared to many other equivalently developed societies.

This is such a Goddamn shame. It couldn't be one of the dozens of faceless, generic anime in development for every season to have this happen - it had to be HSG, one of the smartest and funniest adaptations announced all year? All because of Square Enix' laziness. And a brilliant manga is on the shelf because of all this too.

The really stupid part is that SNK benefits from what the manga does if anything, though that's not going to stop them from trying to cash in.

So what's the punishment for copyright violations in Japan? Are we talking about a fine, or could the author actually end up in jail over this?

The author isn't going to jail. In fact it's likely he's going to end up cleared of any wrongdoing, since it was the publisher's responsibility to get copyright permissions and they likely told him it was "all clear". He's the victim, really.

Most likely scenario is a large fine for Squeenix, and the manga never resumes. Sad, but probable.

I wonder how long the anime adaptation will be delayed by this...

Sad too since I just read the latest chapter yesterday and really been enjoying this to see it in animated form.

There's no chance the anime will go forward unless the manga gets reinstated. There's not enough financial incentive for the production committee otherwise.

The issue isn't punishment, but whether the franchise could survive or not. There is a real possibility the manga might not be able to get the permission after the lawsuit if the rights holders are angry enough, and that would make it impossible for the manga to be sold ever again.

That is strangest thing about all of this. Why was getting this an issue with SNKP when it wasn't with the others? It doesn't make any sense. I also have a feeling SNKP knew about this all long, but didn't care until it got popular and then decided to snatch the benefits.

I really can't help but feel like there is more to this then we will ever know. :/
