That is true, but the inescapable fact is that all SE had to do was get their permission as they did from Capcom and the others and there would have been no problem. And they even had the gall to print a copyright permissions page implying they had.

That's the main issue, really. It is one thing to forget to give credit and to get permission, it is quite another to pretend you have the permission. That's something lawyers would notice.

The good news is, Squeenix hasn't entirely given up on the series. They've filed a counterclaim asking for a declaratory judgement in their favor. There's a possibility this might get animated before the Tokyo Olympics.

This is such a Goddamn shame. It couldn't be one of the dozens of faceless, generic anime in development for every season to have this happen - it had to be HSG, one of the smartest and funniest adaptations announced all year? All because of Square Enix' laziness. And a brilliant manga is on the shelf because of all this too.
The really stupid part is that SNK benefits from what the manga does if anything, though that's not going to stop them from trying to cash in.

The author isn't going to jail. In fact it's likely he's going to end up cleared of any wrongdoing, since it was the publisher's responsibility to get copyright permissions and they likely told him it was "all clear". He's the victim, really.
Most likely scenario is a large fine for Squeenix, and the manga never resumes. Sad, but probable.

The issue isn't punishment, but whether the franchise could survive or not. There is a real possibility the manga might not be able to get the permission after the lawsuit if the rights holders are angry enough, and that would make it impossible for the manga to be sold ever again.
