Believing in free will means, in principle, that whatever the genetic (even deliberate) or indoctrination you may have received, you are still expected to use your free will to CHOOSE to be a law abiding citizen.

If you believe that it is possible for programming to completely override your free will, then arguably you don't believe in it. The "severity" might be different. For example, one might be programmed only to go so far as being a pickpocket, while another a murderer and the third a full blown terrorists, but they are all controlled by their programming and thus should not be punished - by the time they committed their crime, they had as much choice as a stereotypical machine in their next action.

Of course, the second position is hardly indefensible, but it is a bit arbitrary to just decide certain "levels" of programming should be excused while insisting that another of programming must be overridable by "free will".

There should really be no argument at all. Canon shows that Scaglietti did have free will--he betrayed his masters, even instructed Due to kill them.

If they had stripped him of his will and completely mentally dominated him, he would have been incapable of betraying them.

So he was perfectly aware of what he was doing. It was of his own volition. There's no wallbanger in sentencing him to prison for the rest of his life.
