I'll just note that Usenet is off the grid for many people anymore... waiting to see when IRC gets targeted.
I suspect the ISPs will be mostly disinterested in actually punishing anyone... except the bandwidth hogs. I'm almost certain the ISPs agreed to this deal because it allows them to scapegoat the content gatekeepers when they terminate the service of people who actually use the bandwidth they pay for...
