Jailed for sharing manga

Today's edition of Daily Yomiuri brings news about people arrested in Japan for sharing manga via Winny:

KYOTO--Three persons, including a minor, have been arrested on suspicion of posting cartoons from comics onto the Internet via the Winny file-sharing software, before the comics had been officially released, police said.

According to the police, on several occasions between Jan. 31 and April 5, the three allegedly scanned onto a computer 12 cartoons drawn by six cartoonists printed in comic magazines, including Weekly Shonen Sunday, published by Shogakukan Inc., and Weekly Shonen Jump, published by Shueisha Inc.

I don't read anywhere they are being jailed.. I just read they are arrested..

Winny is a Japanese peer to peer file sharing program.

Jailed... @.@... I guess this is a first to see the laws actually enforced? (For manga anyway)

Folks, there's no reason to get all that agitated.
There are several terabytes worth of manga scans on winny (among several more terabytes worth of other media) for years now. It's not like law enforcers actually learned about that fact a few days ago.
The crucial part of that incident is that they caught several people who scanned stuff several days before they even hit the shelves AND then bragged about it on 2channel.
If you ask me, those guys basically asked to be arrested. Apparently it looks like they see pre-release scans as a greater sales threat than "regular" post-release scans.
I don't think this will any effect to Japans scanning world at all. Maybe they'll cut down on pre-release stuff abit, but that's all then.

Yes, uploading before pre-release does warrant an arrest in my book. I mean not even giving the publisher time to release it first is an ultimate doom to sales.

Well, corporations cannot just sit and watch when there are people sharing mangas before release. it will hurt their revenue. My guess is that those people get the manga at the printing shop because people at the publishing companies are not stupid enough tot release them.

But, this might slow down some of scan work. main purpose of legal action is to make an example to scare scanners.

It's just like when Axel .G broke the Source Code for Half-Life 2, and users got it before it was ever released which killed some of the revenue. Or I do believe it was so. ^_^

Scanning and sharing copyrighted material is technically wrong regardless of the situation. But it's obviously a lot worse when it is done before official release.

Much as I feel for them, having such a messed up legal system look at what happened to Winny's creator, in this case I have to say they had it coming.
